Verdict Questioned in Florida Rape Trial

I know no more of the case than you reported. Nonetheless, I wonder: Was the judge remiss in instructions to the jury?
I had thought that sex without consent was rape. Surely consent requires a conscious individual. The conviction for delivering LSD to an unknowing person resulting in their losing consciousness, and then having sex with the unconscious individual, seems to lead inexorably to a finding of guilt on rape charges.
