Appeals Court Overturns Inmate’s Death Sentence

A federal appeals court overturned the death sentence of a 21-year death row inmate, saying the state’s definition of “exceptional depravity” in capital cases is too vague.
The 2-1 ruling by the U.S. 8th Circuit Court of Appeals sends the case of Carey Dean Moore, 42, back to a lower court for a new sentencing.
Moore was convicted in 1980 of murdering two Omaha cabdrivers during a robbery.
State Atty. Gen. Don Stenberg said the state will appeal.
